Mary, August 4, 2012, the day of our engagement.
Guardian Abuse is a very serious problem in this country, and the elderly with assets and the disabled suffer the consequences
According to the Government Accountability Office (GAO) and the U. S. Senate's Special Committee on Aging it is a Three Billion Dollar fraud against the elderly and disabled each year.
The fact that there are not adequate laws to address the problem, is not the problem. The problem is, the laws are not aggressively enforced, and the culprits are not prosecuted.
In Kentucky the employees and officials in the Cabinet for Health and Family Services (CHFS) are part of the problem.
INTRODUCTION
Guardianship abuse is a very serious problem nationwide. Crooked lawyers and corrupt judges steal and embezzle a lot of money for the disabled and elderly, and in some cases for people that are not disabled. When a person gets caught up in the process, it is very difficult to regain what is lost. The is not that there are laws to protect the elderly and disabled, there are adequate laws. The problem is the laws are ignored or outright violated with impunity. This website will detail one unjustified case that cost my wife and me $2.5 million and her freedom in the golden years of her life, and not one single thing that was done was legal.
STATEMENT OF FACTS
On the 11th day of May, 2015, Mary Ellen Reynolds [hereinafter referred to as Mary] and I were married by the Woodford County Judge/Executive in Versailles, Kentucky. A week later, her estranged daughter retained Seth Thomas of Nicholasville to assist her in filing for guardianship/conservatorship over her mother, Mary, Case No. 15-H-001-003. She supported her Petition with her affidavit which was plagiarized from a professional legal publication and mostly false. Then she filed an affidavit attested to by a doctor that claimed that Mary was "disabled." However, the same day that he signed his affidavit, he stated in Mary's medical record that her judgment was "normal." The medical record was co-signed by a neurologist. Medical records are competent evidence and perjured affidavits are not.
A small part of the legal actions I have pursued during the last eleven years are address in the referenced letters, complaints and requests for law enforcement action follows:

Hon. Harold "Hal" Rogers Congressman (Ky. 5th) 551 Clifty Street Somerset, KY 42503
Dear Congressman Rogers:
I need your assistance--if the Congressional Rules--allow you to do so.
Starting in 2015 in Woodford County and continuing until the present time, all of my wife's and my assets--approximately $2.5 million were stolen, used, misused, and embezzled from us without a single act being legal.
I filed numerous legal actions in state courts, the federal courts in Lexington and Frankfort, and the Sixth Circuit Court of Appeals seeking justice. Not one culprit was brought to justice; notwithstanding numerous state, federal statutes were violated and several opinions of the United States Supreme Court were not followed. I do not believe that what the government offices and agents did were done by incompetence or ignorance, but that they were bribed to violate the controlling laws and cost us everything we had. More details are stated in the letters, etc., to government agencies which follow
I visited the FBI's offices in Lexington and Louisville and the United States Attorney's office in Lexington without any action being taken. It appears that they are not complying with the Adult Abuse Prevention and Prosecution Act of 2017, Pub. L. 115-70, 34 USC Section 10101.
Mary was transported at least twice by EMS unnecessarily--once from Versailles to The Willows at Citation, Lexington and once from The Willows to St. Joseph in Lexington to a cartologist that did not treat her, remarking that he had seen her records and nothing was wrong with her. Medicare was billed for the runs which were unnecessary because she had already received medical care for her ailments. This was Medicare fraud and abuse.
In closing, I don't know if you have authority to act on this request.
Thank you for your consideration.
Sincerely, Artis Anderson

Gentlemen:
This is a Complaint and request for an investigation regarding corruption the Kentucky judicial system.
STATEMENT OF FACTS
Mary Ellen Reynolds [hereinafter referred to as Mary] and I were married on the 11th day of May 2015 by the Woodford County, KY, Judge/Executive. The Kentucky Court of Appeals found that we were married in the above referenced Appeal No. 2023-CA-1342-OA.
About a week after we were married, Mary's estranged daughter filed a Petition in the Woodford District Court seeking guardianship/conservatorship over Mary. According to her testimony, she was seeking to petition for the annulment of our marriage. The daughter had retained Seth Thomas of Nicholasville as her counsel.
Mr. Thomas had recently done legal work for Mary and was privy to all of her money, investments and real estate holdings. His acceptance of the daughter as a client in an adverse proceeding was a conflict of interest prohibited by the Kentucky Bar Code.
It was also a violation of the Kentucky Bar Code for Mr. Thomas to fail to advise the daughter that a guardian/conservator COULD NOT seek the annulment of a ward's marriage, Johnson v. Johnson, 294 Ky. 77, 190 S.W. 2d 889 (1943) followed by the Kentucky Supreme Court, Richel v. Richel, 504 S.W. 3d 7 (1976). The Kentucky Bar Code also required Mr. Thomas to verify via research that his actions were based on firm legal grounds which would have ascertained that Mary had to be determined to be disabled prior to the marriage before disability could be pleaded, Smith v. Flynn, 390 S.W. 3d 157.
Mr. Thomas filed an affidavit signed by a Dr. Quisenbury that Mary was disabled; however, Dr. Quisenbury stated in Mary's medical records dated the same day that he signed his affidavit, that her judgment was "normal." The medical record was co-signed by a neurologist.
The local prosecutor was required by law to prove Mary disabled. He made no effort to do so. Mr. Thomas acted as a self-appointed prosecutor and Judge Vanessa M. Dickson allowed him to do so. At the final trial, the prosecutor did not asked a single question of any witness. Mary had talked to the prosecutor and told him she did not want her daughter over her or her affairs. Being able to express her desires and wishes in an articulate and rational manner deprived the court to appoint a guardian/conservator.
After Judge Dickson appointed the Kentucky Cabinet for Health and Family Services (CHFS) as Mary's guardian/conservator, it assigned Patricia WILEY as Mary's slave master depriving her of her freedom and robbing her of thousands of dollars. After WILEY was fired by the state for lying and stealing, Robert Horn--a well known liar and thief and predator guardian was appointed as Mary's guardian//conservator after ADMITTING he had been paid money by Wiley for goods and services that he had not provided for Mary's benefit.
"A transaction with a person not adjudged insane will not be annulled unless insanity is so obvious that ordinarily prudent persons would take notice thereof, . . . ." Cummins' Adm'r v. Walker's Committee, 252 Ky. 5, 66 S.W. 2d 48. "[T]he burden of proof is upon upon him that assets the lacks lacks such capacity. . . . To overcome this presumption, . . . there must be more than a mere equilibrium of testimony." Bevins et al. v. Lowe et al. 159 Ky. 439, 167 S.W. 423.
The Evidence v. The Law
The initial Petition for guardianship/conservator by Mary's daughter was perjured and largely plagiarized from 13 L. J. Fam. & Stud. 187 (2011).
The daughter's attorney, Seth Thomas, introduced as evidence an affidavit attested to by Dr. Quisenberry that Mary was disabled. Dr. Quisenberry stated in Mary's medical record dated the same day that he signed his affidavit that Mary's judgment was "normal."
The daughter stated that she was seeking guardianship/conservatorship over her mother to enable her to seek the annulment of Mary's and my marriage, Seth Thomas had a legal duty to advise the daughter that a guardian/conservator could not seek the annulment of a ward's marriage. Johnson v. Johnson, 294 Ky. 77.
Kentucky had to prove--by clear and convincing evidence--Mary was disabled and Kentucky was to be represented by the local County Attorney. KRS 387.570(5). The county attorney made no effort to prove Mary disabled have had a rational and articulate conversation her hours prior to the hearing. The Court permitted Seth Thomas to act as a self-appointed county attorney.
After the Court had appointed CHFS as Mary's guardian/conservator, its assigned guardians/conservators violated every constitutional and federal statute right that I had as her spouse. These rights supersede every state law to the contrary, U. S. Const. Art VI.
Assigned guardian/conservator, Patricia WILEY, represented by Seth Thomas, filed a Petition in Jessamine Family Court and Judge MOSS granted it without any jurisdiction in violation of my constitutional rights to Equal Protection and Due Process of Law, criminal per Title 18 United States Code Section 242, and other acts by illegally appointed guardians/conservators violated other federal criminal laws, e.g., Hobbs Act, Medicare fraud, Honest Services Fraud, etc.
Mary's and my total loss was about $2.5 million and not one single thing that was done by the courts was legal. No court has any jurisdiction to appoint a guardian/conservator over a person that can communicate rationally and make their desires and wishes known.
LEGAL CLAIMS
A spouse has legal rights that the state cannot trespass. A spouse has the right to make medical decisions, determine visitation, taxation, inherence, etc. Obergefell v. Hodges, 576 US 644, 670.
Until a person is determined to be disabled by a court of law, they are liable for their deeds. Smith v. Flynn, 390 S.W. 3d 157.
Citizens have a right to force compliance with constitutional law. George R & R Banking v. Redwine, 342 US 299. However, constitutional rights mean nothing when courts violate their oath of office and make a mockery of the constitution. Cooper v. Aaron, 358 US 1, 17--19.
Court opinion that violate the law have no validity. They are nullities and can be attacked in any court at any time. Jordan v. Gilligan, 500 F. 2d 701 (6th Cir. 1974) Cert. Den. 421 US 991; Ramsey's Ex'r v. Ramsey, 233 Ky. 507, 36 S.W. 2d 37.
People have a right to have their constitutional right vindicated without delay. Watson v. City of Memphis, 373 US 526.
Violations of citizens' right under color of state law is criminal pursuant to Title 18, Section 242.
There are many victims of guardianship abuse with victims in many if not every state. A Saint Louis T.V. station--KMBC-TV 9--covered it in Missouri under the heading, "Paper Prison." No one with assets are safe from predator guardians because lies and perjury are more the norm than the exception. The Trump Administration appears to be far more aggressive in prosecuting the thieves and embezzlers than any prior administration. Ref. Facebook, search National Association to Stop Guardianship Abuse, https://stopguardianabuse.org.
CONCLUSION
Hundreds of Complaints are submitted to the Ky. Bar Association each year. All but a few are summarily dismissed without serious investigation. A few are exceptional cases: For example, Dawn Gentry was reported for having alcohol and sex parties in the courthouse; however, that was not the behavior that resulted in a bar complaint. Some local attorney(s) became angry because she was only appointing attorneys that contributed to her political campaigns to lucrative guardianship/conservative cases. Gentry v. Kentucky Bar Association, 644 S.W. 3d 502. Another case regarded Beth L. Maze for forging another judge's name to a court order. The biggest case of all was the case of "Mr. Social Security, Eric C. Conn, who allegedly defrauded the Social Security out of a half-billion dollars by bribing doctors to provide fraudulent medical reports to enable his clients to obtain disability Social Security benefits. Conn v. Ky. Bar Association, 538 S.W. 3d 290 (2018).
Given the sum total of the laws violented in this case and the amount of money used, misused, stolen, embezzled, etc., the circumstantial evidence strongly suggest that witness was bribed to lie and commit perjury and judges were bribed to fail to comply with controlling laws.
Legal services are seriously need. https://www.gofundme.com/f/donate-to-help-us-find-stability-again-xer5u
